Welcome to Sage & Wren.

These Terms of Service (“Terms”) apply when you visit our website, use our online store or purchase products from Sage & Wren.

Our store is powered by Shopify, which provides the ecommerce platform that enables us to sell our products and services to you.

Please read these Terms carefully before using our website or placing an order. By using our website or purchasing from Sage & Wren, you agree to these Terms together with our Privacy Policy, Returns & Refunds Policy and Shipping Policy.

Nothing in these Terms affects your statutory rights under UK consumer law.

1. Using Our Website

You may use the Sage & Wren website for lawful, personal purposes.

You must not use our website in a way that could damage, disable or interfere with its operation or security, attempt to gain unauthorised access to the website or related systems, introduce malicious software, use the website for fraudulent or unlawful purposes, or infringe the rights of Sage & Wren or another person.

We reserve the right to restrict access to our website where reasonably necessary to protect Sage & Wren, our customers or our services.

2. Products

We take reasonable care to ensure that product descriptions, photographs, mock-ups, measurements, colours and other information displayed on our website are accurate.

However, colours may appear slightly different depending on your screen, device and display settings.

For personalised products, mock-ups and examples may be used to demonstrate the style or positioning of a design. Because personalised products are created individually, reasonable variations may occur between examples shown on the website and the finished product.

Product availability may change and we may discontinue products or designs at any time.

Nothing in this section affects your rights where goods are faulty, not as described or otherwise fail to conform to your contract with us.

3. Personalised and Bespoke Products

Sage & Wren offers products that may be personalised or made to a customer's individual specifications.

This may include names, dates, photographs, pet portraits, customer-supplied images, personalised text, tartan-inspired designs or other details selected or provided by you.

You are responsible for checking the information you provide when placing your order, including spelling, names, dates, photographs and other personalisation details.

We will create your product using the information supplied or approved by you.

If Sage & Wren makes an error when producing your personalised item, please contact us so that we can put it right.

Cancellation and change-of-mind rights may not apply to goods made to your individual specifications or clearly personalised. Please see our Returns & Refunds Policy for further information.

4. Customer-Supplied Images, Photographs and Content

Where you provide Sage & Wren with a photograph, image, artwork, text, logo or other content for use in a personalised product, you confirm that:

  • you own the content or have permission from the relevant owner to use it for this purpose;

  • our use of the content to create your order will not infringe another person's copyright, trademark, privacy or other rights; and

  • you authorise Sage & Wren to reproduce, adapt or otherwise process the content as reasonably necessary to create and fulfil your order.

You retain ownership of content that belongs to you. Providing content to us does not transfer ownership to Sage & Wren.

We will use customer-supplied content for the purpose of processing and fulfilling the relevant order and otherwise in accordance with our Privacy Policy.

We reserve the right to decline content or refuse an order where we reasonably believe that the requested use may be unlawful, infringe another person's rights, or contain seriously abusive, hateful or otherwise inappropriate material.

5. Orders

When you place an order through Sage & Wren, you are offering to purchase the products in your order.

After placing an order, you will receive an electronic acknowledgement or confirmation.

We reserve the right to decline or cancel an order where there is a legitimate reason to do so, including where:

  • a product is unavailable;

  • there has been an obvious pricing or product-description error;

  • payment cannot be authorised;

  • we cannot reasonably fulfil the personalisation requested;

  • information required to fulfil the order has not been provided; or

  • we reasonably suspect fraudulent or unlawful activity.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

6. Changes and Cancellations

For standard, non-personalised products, your cancellation and return rights are explained in our Returns & Refunds Policy.

For personalised or bespoke products, change-of-mind cancellation rights may not apply where the goods are made to your specifications or clearly personalised.

Where possible, we will try to accommodate a requested change before production begins, but we cannot guarantee that changes can be made once work on a personalised order has started.

Nothing in this section affects your statutory rights.

7. Prices and Payment

All prices displayed on our website are shown in pounds sterling (GBP) unless stated otherwise.

Sage & Wren is not currently VAT registered, and our prices do not include VAT charged by Sage & Wren.

Applicable delivery charges will be displayed before you complete your purchase.

Payment must be made using one of the payment methods offered at checkout.

Payments are processed securely through Shopify and the payment providers made available through our store. Sage & Wren does not directly store complete payment-card details.

We reserve the right to change our prices at any time. Changes will not affect orders already accepted at an agreed price.

8. Shipping and Delivery

Sage & Wren currently delivers to eligible addresses within the United Kingdom.

Products are made and prepared for dispatch according to the estimated fulfilment times displayed on our website or at checkout.

Delivery estimates begin after an order has been dispatched unless expressly stated otherwise.

Delivery dates and transit times are estimates and may occasionally be affected by circumstances outside our reasonable control.

Our current delivery methods, charges and estimated timescales are explained in our Shipping Policy.

Risk in the goods remains with Sage & Wren until the goods come into your physical possession or the possession of a person identified by you to receive them, subject to applicable UK consumer law.

9. Returns, Refunds and Faulty Goods

Returns, cancellations, refunds and exchanges are governed by our Returns & Refunds Policy and applicable UK consumer law.

Nothing in these Terms limits your statutory rights where goods are faulty, damaged, not as described or otherwise do not conform to your contract with us.

10. Customer Accounts

You may have the option to create or use a customer account.

You are responsible for ensuring that information associated with your account is accurate and for taking reasonable steps to keep access to your account secure.

Please contact us if you believe your account has been accessed without your permission.

You are not required to create a customer account simply to purchase from Sage & Wren unless our checkout expressly states otherwise.

11. Intellectual Property

Unless otherwise stated, the Sage & Wren website and the original content created by Sage & Wren — including our branding, original designs, graphics, photographs, text and other materials — belong to Sage & Wren or are used by us with permission.

You may view and use our website for your own personal, non-commercial purposes.

You must not reproduce, copy, distribute, sell or commercially exploit Sage & Wren content without our permission unless you have a legal right to do so.

Third-party trademarks, artwork and other intellectual property remain the property of their respective owners.

Nothing in this section claims ownership over photographs, artwork or other content supplied to us by customers.

12. Relationship With Shopify

Sage & Wren is powered by Shopify, which enables us to provide our online store and Services to you.

However, purchases made through our store are made directly with Sage & Wren. Shopify is our ecommerce platform provider and is not the seller of Sage & Wren products.

Shopify may provide services involved in operating our store, including ecommerce functionality, checkout and payment-related services.

Your use of certain Shopify services may also be subject to Shopify's applicable terms and policies.

13. Third-Party Services and Links

Our website may contain links to third-party websites or use services provided by third parties, including payment, delivery and ecommerce providers.

We are not responsible for the content, availability or privacy practices of independent third-party websites.

If you choose to use a third-party website or service, its own terms and privacy policies may apply.

14. Privacy

We process personal information in accordance with our Privacy Policy and applicable UK data protection law.

Our store is hosted by Shopify, which processes certain information in connection with providing its services.

15. Marketing

Where you choose to receive marketing communications from Sage & Wren, you may unsubscribe at any time using the unsubscribe option included in our marketing emails.

Service messages relating to an order, payment, delivery, customer account or customer-service request are not marketing communications and may still be sent where necessary.

16. Promotions and Discount Codes

From time to time, Sage & Wren may offer promotional discounts, codes or special offers.

Additional terms may apply to a particular promotion.

Unless otherwise stated, promotional codes cannot be exchanged for cash and may not be combined with other promotions.

We reserve the right to withdraw or amend a promotion where reasonably necessary, but this will not affect orders already accepted under that promotion.

17. Errors and Availability

We make reasonable efforts to keep information on our website accurate and up to date.

Occasionally, errors may occur in product descriptions, prices, availability, delivery information or other website content.

Where we discover an obvious error affecting an order, we will contact you as soon as reasonably possible and explain the available options.

We will not use this provision to remove or restrict rights you have under UK consumer law.

18. Our Responsibility to You

We do not exclude or limit liability where it would be unlawful to do so.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Nothing in these Terms limits your statutory rights as a consumer.

Sage & Wren supplies products for personal and domestic use. To the extent permitted by law, we are not responsible for business losses arising where a consumer purchases a product for purposes connected with a trade, business or profession.

We are not responsible for losses caused solely by circumstances outside our reasonable control where the law permits such a limitation.

19. Events Outside Our Reasonable Control

We will not be responsible for a delay or failure to perform our obligations where this results from circumstances outside our reasonable control.

This may include significant postal disruption, severe weather, transport disruption, widespread service outages or other events that we could not reasonably prevent.

Where such an event affects an order, we will take reasonable steps to minimise disruption and keep you informed where appropriate.

Your statutory rights remain unaffected.

20. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, website, services or applicable law.

The version applying to your purchase will normally be the version in effect when your order is placed.

The latest version will be published on our website with an updated revision date.

21. Governing Law

These Terms and purchases made from Sage & Wren are governed by the laws of Scotland, subject to any mandatory consumer protections that apply to you.

If you are a consumer living elsewhere in the United Kingdom, you will retain any rights you have under the mandatory laws applicable to you and may be entitled to bring proceedings in the courts applicable to where you live.

Nothing in these Terms restricts any rights you have under applicable consumer law.
